Cultivation and Sale of Marijuana in West Tisbury
Local Approval Process for Siting:
The Town’s Zoning Bylaw is the regulatory document for local approval. Article 3 Section 3.1-1 “Zoning District – Use Tables : Allowable Uses” . Marijuana uses are allowed by Special Permit in the Mixed Business (Retail) and Light Industrial District (Cultivation).
Special Permits are granted by the Zoning Board of Appeals (ZBA). Their information can be found here: Zoning Board of Appeals | West Tisbury, MA
The ZBA meets on Thursdays at 5:00 pm, all information about filing for a special permit can be found on their webpage. All contact information for the ZBA will also be found on the web page.
The ZBA does not use a scoring system for any special permits. Each permit is reviewed on its merits directly related to the location and impacts on the neighborhood.
Local Approval Process for Host Agreements:
The Select Board, which meets on Wednesdays at 4:30 pm, is the granting authority for Cannibis Licenses in the Town. The Board presently does not require host agreements. The Board welcomes any business applicant and encourages social equity businesses to engage with the community.
